Terms of Service

These Terms and Conditions (“Terms”) govern your access to and use of Handy Homes Services Inc.’s websites, mobile applications, related technologies (collectively, the “Service”), and our in-home services, including membership services and fixed-price project work (e.g., painting) performed by our employees and subcontractors (“HandyPros”). By using the Service or approving an estimate/proposal, you agree to these Terms and to our Privacy Policy. We may update these Terms by posting a new version with the “Last updated” date. If a change is material, we will notify you via the Service, email, or other reasonable means. Your continued use of the Service or approval of new work after the effective date constitutes acceptance.
PROJECT WORK; ESTIMATES INCORPORATED BY REFERENCE
In addition to membership services, Handy Homes performs fixed-price or time-and-materials “Project Work.” The written estimate/proposal you approve (the “Estimate”) describes the job-specific scope, inclusions/exclusions, schedule window, price, and any project-specific warranty. By approving an Estimate, you agree that the Estimate is incorporated into and forms part of your agreement with Handy Homes. If there is a conflict, the Estimate controls for scope, schedule window, and price; these Terms control for all legal provisions (including payment authorization, default/collections, change orders, communications consent, limitations of liability, dispute resolution, and governing law).
ELECTRONIC TRANSACTIONS AND SIGNATURES
You consent to electronic records and signatures. Clicking “Accept,” checking a box, typing your name, drawing a signature on a device, replying “Approved,” or paying a deposit constitutes your electronic signature on the Estimate, change orders, close-out forms, and invoices. You may request paper copies at no charge.
ACCOUNTS AND ELIGIBILITY
Provide accurate information, keep credentials secure, and be at least 18 years old to use the Service. You are responsible for activity under your account.
FIELD CONDITIONS; STANDARDS; SCHEDULING
Unless your Estimate states otherwise, Project Work is performed consistent with PCA/PDCA industry standards for preparation and application (normal viewing distance). We apply coatings only within manufacturer-specified temperature, humidity, wind, and surface-condition ranges; schedules may shift to protect the finish and any warranty. You will provide clear access to work areas, power, water, reasonable parking/driveway access, and secure pets/valuables. If the Estimate requires lifts/permits/HOA approvals, we will note who is responsible for obtaining them.
CHANGE ORDERS (PROJECT WORK)
If conditions differ from what was reasonably visible at estimating (e.g., concealed rot, substrate failure, moisture, lead-safe requirements) or if you change colors, products, prep level, or scope, we will issue a written change order showing price/time impact. Approval may be given electronically (on device, via link, or written reply). No change work proceeds without approval.
SUBSTANTIAL COMPLETION; FINAL ACCEPTANCE; PUNCH LISTS
“Substantial Completion” means the work is usable for its intended purpose and only minor items remain that do not affect function or weather protection. At this stage we document a Punch List with completion dates. “Final Acceptance” occurs when (a) Punch List items are completed or waived, (b) the site is cleaned of our materials and masking, and (c) you execute our Final Acceptance acknowledgement (electronically or in writing). Warranty periods start on the Final Acceptance date unless your Estimate states otherwise.
PAYMENTS; AUTHORIZATION; INVOICING; TAXES
Unless the Estimate states otherwise, a deposit is due at approval to schedule, any progress payments are due as listed in the Estimate or approved change orders, and final payment is due at Final Acceptance. We accept card/ACH and may pass through disclosed non-cash fees (e.g., 3% card fee). Prices exclude taxes unless noted; you are responsible for applicable taxes. You authorize Handy Homes and our payment processor to store your payment method and charge it for deposits, progress payments, approved change orders, and the final balance when due. You represent you are authorized to use the instrument and will keep it current. You will receive an emailed receipt for each payment. For Project Work we maintain time-stamped photos, daily logs, acceptance records, and IP/timestamp evidence of e-signatures, along with copies of Estimates and change orders, to support billing. Custom-tinted paints/stains and special-order items are non-returnable once ordered and may be invoiced if you change selections after ordering.
CHARGEBACKS; RIGHT TO CURE; DISPUTE PROCEDURE (PRE-ARBITRATION)
If you have a billing or service concern, email hello@handyhomes.com within 10 days of the invoice. We will promptly review, schedule any inspection, and propose a resolution or cure. You agree not to initiate a card chargeback unless you reasonably believe the charge is unauthorized or we failed to deliver as documented. Initiating a chargeback does not void your obligations under these Terms. We may re-present the transaction with documentation (signed Estimate/change orders, delivery logs, photos, Final Acceptance, and communications). Deposits reserve labor/equipment and may be partially or fully earned upon receipt as indicated on the Estimate; progress payments reflect value delivered to date. This section does not limit any rights you have under card-network rules or law; it sets a reasonable dispute path and authorizes us to provide evidence.
DEFAULT; COLLECTIONS; LIEN RIGHTS; SUSPENSION
Past-due balances may accrue late charges of 1% per month (or the maximum permitted by law). We may pause or reschedule work until accounts are current. We reserve all lien rights and may pursue lawful steps to secure payment. If we must collect, you agree to pay reasonable collection costs and attorneys’ fees permitted by law.
WARRANTY (SUMMARY)
Any workmanship or product warranty for Project Work is described on your Estimate and begins on Final Acceptance. Warranty remedies are repair of affected areas only. Common exclusions include: substrate movement, moisture intrusion, tannin bleed, rust, mildew/mold, horizontal/walking surfaces, prior coating failure, unusual wear, or use of incompatible cleaners. Full warranty terms (if provided) will accompany your Estimate or completion documents.
PHOTOS & RECORDINGS
We may take job-site photos/videos for records, quality control, and warranty. We use images for marketing only with your explicit opt-in (revocable at any time by emailing hello@handyhomes.com).
COMMUNICATIONS CONSENT
You authorize us to contact you by SMS/text, phone, push notification, and email for transactional purposes (estimates, scheduling, updates, change orders, invoices, and warranty). Message/data rates may apply. Marketing texts/emails are optional and require your opt-in.
THIRD-PARTY SERVICES AND PAYMENT PROCESSING
We use trusted third-party providers (e.g., Stripe, Inc.) to process payments. Their terms and privacy policies apply in addition to these Terms. Handy Homes does not store full card numbers and is not liable for processor errors beyond what the law requires.
INTELLECTUAL PROPERTY; CONTENT; ACCEPTABLE USE; DMCA
Your existing IP/Content/Acceptable-Use/DMCA provisions apply to the Service.
DISCLAIMERS; LIMITATION OF LIABILITY
Your existing disclaimer of warranties and limitation of liability apply to membership and project work, subject to New Jersey law (including your NJ carve-out).
DISPUTE RESOLUTION; ARBITRATION; CLASS-ACTION WAIVER
Your current arbitration/class-action waiver section applies to all disputes not resolved through the cure process above. Pre-arbitration notice address: Handy Homes, 6 Hunt St #108, Rumson, NJ 07760.
GOVERNING LAW; VENUE; MISCELLANEOUS
These Terms are governed by New Jersey law. For any dispute not subject to arbitration, the exclusive venue is in Monmouth County, NJ (or the U.S. District Court for the District of New Jersey). You may not assign these Terms without our consent; we may assign them. Force-majeure and other general clauses in our Terms remain in effect.
CONSUMER CANCELLATION (WHERE REQUIRED BY LAW)
If applicable law provides a 3-business-day right to cancel for certain in-home solicitations, we will provide the required notice and instructions with your Estimate.
